Graydon Head’s Construction Industry Group is a one-stop legal services shop for our construction clients.  Our construction attorneys counsel owners, developers, design-builders, general contractors, subcontractors, suppliers, architects and engineers on all aspects of construction projects, both private and public and commercial and residential.  We serve as aggressive advocates for our clients in pursuing, defending and resolving claims that arise out of construction projects, while at the same time advising our clients on pro-active and practical steps they can take before, during and after construction projects to avoid the cost and expense associated with construction claims.  Our services include:

Construction Litigation   We zealously represent our clients in state and federal court in construction disputes ranging from multi-million dollar complex construction defect or impact claim cases to simple contract balance collection actions.   We pursue and defend all types of claims that may arise from construction projects, including claims for construction and design defects on commercial and residential projects, water intrusion and mold claims, change order disputes, contract and payment disputes, delay claims, claims for loss of productivity and loss of efficiency, insurance coverage disputes, performance and payment bond claims, bid protests and mechanic’s lien claims on public and private projects.  Since many of our construction clients operate around the country, we have litigated and arbitrated cases in numerous jurisdictions throughout the United States.

Alternative Dispute Resolution   Not all construction claims end up in court.  In fact, the vast majority of construction contracts require some form of alternative dispute resolution such as mediation and arbitration.  Our attorneys are experienced in guiding clients through these processes.  Even when not contractually required, our attorneys actively pursue these alternative dispute resolution processes, which can be more efficient and less expensive alternatives to litigation. We are big proponents of creative alternative dispute resolution so that your company can invest its resources into its projects and into its future growth.   We have attorneys trained and experienced as both mediators and arbitrators who provide our clients with a unique perspective on these dispute resolution processes.  

Contract Preparation & Negotiation  One of the best ways to protect our construction clients from claims or disputes, to facilitate successful prosecution or defense of claims, and to increase the likelihood that projects will be completed in a timely and cost effective manner is effective contract preparation and negotiation.  Our attorneys have experience with all of the standard industry contract forms, as well as numerous customized contracts.  This experience allows us to advise our clients regarding the provisions that need to be included and excluded from a construction contract.   

Construction-Related Insurance   We know the ABCs of CGLs and EOs.  We are experienced in dealing with and understand Commercial General Liability Policies, Excess and Umbrella Policies, Products/Completed Operations Coverage, Builder’s Risk Coverage and Architect and Engineer Errors and Omissions Policies.   We have the practical and legal background to deal effectively with the sometimes-complex interplay between the requirements of the construction contracts for the job and the insurance that was actually obtained (or that should have been obtained) by various project participants.
